ProTattoo Terms of Service

1. Acceptance of Terms

Welcome to ProTattoo, an AI-powered tattoo design application ("App") developed and operated by BLLEKHOLL ("we," "us," or "our"). By downloading, installing, or using the ProTattoo mobile application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and BLLEKHOLL. We reserve the right to modify these Terms at any time. Your continued use of the App after any changes constitutes acceptance of the modified Terms.

2. Service Description

ProTattoo is an AI-powered mobile application that generates custom tattoo designs based on user inputs. The App allows users to:

• Generate AI-created tattoo designs using text prompts and style preferences
• Save and organize favorite tattoo designs
• Customize designs with various artistic styles
• Purchase credits to unlock and generate designs

The App uses artificial intelligence technology to generate designs. While we strive to provide high-quality results, the output is algorithmically generated and may vary in quality and accuracy.

3. Subscriptions and Purchases

ProTattoo offers free credits and subscription-based access to generate tattoo designs.

3.1 Free Credits and Pro Subscription

Each new user receives 2 free credits upon registration. After using your free credits, you may purchase a Pro subscription (available as weekly or yearly plans) through Apple's In-App Purchase system, which provides unlimited design generations.

3.2 Usage Quota for Unlimited Plans

Pro subscription users enjoy unlimited generations subject to fair usage. If a user exceeds the usage quota within a billing period, generations may be processed using alternative AI models that are more cost-efficient. The usage quota resets every 30 days. We reserve the right to determine and adjust quota limits at our sole discretion, as AI processing costs are variable and unpredictable.

3.3 Non-Refundable Policy

ALL PURCHASES ARE NON-REFUNDABLE. Once you complete a purchase through the App, the transaction is final. We do not offer refunds for:

• Unused subscription time
• Designs generated that do not meet your expectations
• Accidental purchases (please carefully review your purchase before confirming)
• Change of mind after purchase
• Technical issues on your device that prevent proper use of the App

By making a purchase, you acknowledge and agree to this non-refundable policy.

3.4 Payment Processing

All purchases are processed through Apple's In-App Purchase system and are subject to Apple's terms and conditions. Payment will be charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

4. AI-Generated Content Disclaimer

The tattoo designs generated by ProTattoo are created using third-party artificial intelligence technology. You understand and agree that:

• AI-generated designs may not always meet your expectations or requirements
• The quality, accuracy, and suitability of designs may vary
• Designs are for inspiration and reference purposes only
• We do not guarantee that any design will be suitable for actual tattooing
• You should always consult with a professional tattoo artist before getting any tattoo
• We are not responsible for any tattoo results if you choose to use our designs
• Third-party AI model providers may use your inputs and generated outputs to train and improve their future models

The App is provided "as is" without any warranties regarding the quality or appropriateness of generated designs.

5. Intellectual Property Rights

5.1 App Ownership

The ProTattoo App, including all software, code, features, and functionality, is owned by BLLEKHOLL and is protected by copyright, trademark, and other intellectual property laws.

5.2 Generated Designs

You retain ownership rights to designs you generate using the App. However, you acknowledge that:

• Similar or identical designs may be generated for other users due to the nature of AI technology
• We reserve the right to use anonymized design data to improve our AI models
• You are responsible for ensuring your use of designs does not infringe on third-party rights

6. User Conduct and Prohibited Uses

You agree not to use the App to:

• Generate content that is illegal, offensive, defamatory, or violates any third-party rights
• Attempt to reverse engineer, decompile, or hack the App
• Use the App for any commercial purpose without our written permission
• Circumvent any access restrictions or payment systems
• Share your account credentials with others
• Use automated systems or bots to interact with the App
• Generate content that promotes violence, hate speech, or discrimination

We reserve the right to suspend or terminate your access to the App if you violate these terms.

7. Privacy and Data

Your use of the App is also governed by our Privacy Policy. We collect minimal data—primarily a unique user ID after onboarding to track free credits and prevent abuse. We do not collect personal information such as name, age, or gender unless you voluntarily provide it. Please review our Privacy Policy for detailed information about how we handle your data.

8. Disclaimers and Limitations of Liability

8.1 No Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLLEKHOLL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any bugs, viruses, or other harmful code that may be transmitted through the App
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content
• The quality or suitability of any AI-generated designs

9. Indemnification

You agree to indemnify, defend, and hold harmless BLLEKHOLL, its officers, directors, employees, and agents from any claims, losses, damages, liabilities, including legal fees and expenses, arising out of your use or misuse of the App, your violation of these Terms, or your violation of any rights of another party.

10. Termination and Account Deletion

We reserve the right to suspend or terminate your access to the App at any time, without notice, for any reason, including but not limited to violation of these Terms. Upon termination:

• Your right to use the App will immediately cease
• Any active subscription benefits will be forfeited without refund
• You must delete the App from all your devices

You may request deletion of your user ID and associated data at any time. To prevent abuse of the free credits system, deletion requests are processed automatically after 30 days.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Kosovo, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Kosovo.

For users in the European Union, you may also have rights under EU law.

12. Apple Terms

This App is available through Apple's App Store and is subject to Apple's Licensed Application End User License Agreement (EULA), which can be found at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.

You acknowledge that these Terms are between you and BLLEKHOLL only, not with Apple, and Apple is not responsible for the App or its content.
